Tell DHS: Don't Let ICE Interfere with Voting. Commit Today.

Election Day is 29 days away. Voting has already started. And President Trump still refuses to rule out sending ICE to the polls.

In May, asked whether he would send the National Guard or ICE to voting locations, Trump said, “I'd do anything necessary.” Asked again in an interview TIME published last Thursday, he said, “Haven't thought of it.”

Homeland Security Secretary Markwayne Mullin has left the door open too. On September 1, he said ICE agents could go to polling places in some cases. DHS now says it has no plans to target polling locations, but it never took back the previous remark. And at least one Republican gubernatorial candidate told supporters he'd ask the government to send ICE to the polls in his state.

This election is too important to accept vague statements and dodges, especially after ICE agents have repeatedly detained U.S. citizens. It's time for Trump officials to commit to allowing every eligible voter to exercise their right to vote without fear of intimidation by federal agents.

Election-law experts say federal law bars armed federal agents from polling places except to repel armed enemies of the United States. A lawsuit alleges ICE agents have already shown up at active polling sites in Texas, California and New York this year. At least three lawsuits now seek to keep federal agents away from election sites.

Agents don't have to arrest anyone to keep people from voting. Nor do charges have to hold up in court. A naturalized citizen, a parent in a mixed-status family, or a poll worker who spots them outside may simply stay home. Election officials are already rehearsing what to do if agents show up. They shouldn't have to.

If DHS truly has no plans, a written directive costs nothing. Mullin can settle this with one memo. If he refuses, voters will know why.
