Donald Trump's Department of Justice is threatening California with legal action unless it sidelines voters' ballots — and it hasn't cited any clear legal authority giving it the power to make that demand. The DOJ gave California election officials just 48 hours to review a federal list of people it claims are "likely noncitizens." It wants officials to segregate their mail ballots, stop sending ballots to those who haven't received them, and halt processing returned ballots until their citizenship is verified. But according to legal experts, neither of the two legal authorities cited by the DOJ establishes its power to order these sweeping actions. This is a brazen attempt to interfere with an election already underway. California officials must refuse to let unverified federal allegations determine whose votes get counted. Tell California Secretary of State Shirley Weber and Los Angeles County Registrar Dean Logan: "Reject the DOJ's demands to sideline ballots based on unverified allegations and protect every eligible Californian's right to vote." Weber has already raised serious concerns about the administration's claims. Responding to earlier allegations from the Department of Homeland Security, she said: "I have serious doubts about the reliability of your data and accuracy of your claims, since my office has not shared our statewide voter registration list with DHS or any other federal agency or official." The DOJ hasn't explained how it generated its latest list or what evidence supports its conclusions. And its own demand acknowledges that eligible citizens could be included among those flagged. Federal law prohibits noncitizens from voting in federal elections. But that doesn't give the DOJ a blank check to dictate how states administer elections or put eligible voters' ballots in jeopardy without reliable evidence. California has a responsibility to verify voter eligibility while protecting lawful voters from wrongful exclusion. If California gives in to this pressure without a clear legal basis, it could establish a dangerous precedent for federal interference in elections across the country. Add your name and demand that California officials stand firm against the DOJ's unsupported demands and protect every eligible vote. The petition to California Secretary of State Shirley Weber and Los Angeles County Registrar Dean Logan reads: "Do not comply with the Department of Justice's demands to sideline ballots based solely on unverified citizenship allegations. Require reliable evidence and clear legal authority, follow established election laws and procedures, and protect every eligible Californian's right to have their vote counted."
