Stop Legislation to Eliminate State Animal Protection Laws

The Senate could soon consider a bill that would strip states and localities of their right to enact laws addressing the inhumane treatment of animals, especially in agricultural settings. The Food Security and Farm Protection Act (S. 1326) is a dangerous, anti-animal bill that threatens decades of progress in protecting animals from cruelty.

This bill would prohibit states from enacting or enforcing laws that regulate how animals are raised for food if those animals, or their products, cross state lines. That includes laws like California’s Proposition 12, a widely supported measure that prevents the sale of pork from animals raised in extreme confinement. Prop 12 was upheld by the U.S. Supreme Court and reflects the will of millions of voters who believe in more humane farming practices.

The so-called "Prop 12 Fix" in S. 1326 would undo that ruling. A wide array of other important state laws are at risk, including those regulating pesticide use on crops, arsenic levels in food, safeguards against lead exposure, and labor protections.

If enacted, this bill will nullify thousands of state and local laws regulating the sale of products derived from animal cruelty, including bans on gestation crates for pigs, veal crates for calves, and battery cages for hens. It would also undermine regulations related to puppy mills, horse slaughter, shark fin sales, and more.

Consumers have the right to know and choose food products that align with their values. States have the right to ensure those choices are available. S. 1326 prioritizes the interests of powerful agribusiness over the wellbeing of animals, public health, and voter-driven policymaking.
