Stand With States Fighting Trump’s Mail Voting Restrictions

Two dozen states and the District of Columbia are taking the U.S. Postal Service to court over new mail-voting rules they say unlawfully interfere with states’ authority to administer elections and could disrupt voting just months before the November midterms.

The lawsuit comes after an earlier legal challenge was disrupted by a Supreme Court ruling. Now, the states are challenging the finalized USPS rule itself, arguing that Congress never gave the Postal Service authority to regulate federal elections or determine which voters can receive ballots by mail.

The states say the last-minute requirements are already forcing election officials to redesign ballot envelopes, develop new systems for submitting voter information to USPS, retrain election workers, educate voters, and prepare polling places for potentially more in-person voters.

Whatever method eligible Americans use to cast their ballots, election rules should be lawful, clear, and implemented in a way that gives voters and election officials sufficient time to prepare. Major changes shortly before an election risk creating confusion and unnecessary obstacles for voters trying to participate.

By returning to court, these states are seeking to protect their constitutional role in administering elections and prevent new federal requirements from disrupting mail voting as the midterms approach.
