Denounce the Supreme Court's Attack on Federal Agencies

The Supreme Court just overturned a 1984 decision known as Chevron. Chevron has instructed lower courts to defer to federal agencies when laws passed by Congress are not clear or detailed enough to interpret. 

Federal agencies have long stood to be the experts in each field, identifying the blanks in bills written by Congress. 

This disastrous decision could lead to courts blocking fundamental rules and regulations on civil rights, the environment, food safety, and more.

Every single regulation President Biden’s administration has announced could now be opened to legal challenges if judges are allowed to discount or disregard the expertise of the agency that put the regulations into place. 

This ruling will shift power away from the executive brand and Congress and toward courts. Craig Green, a professor at Temple University’s Beasley School of Law said, “Federal judges will now have the first and final word about what statutes mean.” 

“That’s a big shift in power,” he added.
