Congress: End Qualified Immunity Now — Justice Can’t Wait

In January, another family was torn apart after a fatal shooting involving federal immigration agents. It was a devastating reminder of a hard truth: qualified immunity continues to shield government officers from accountability, even when lives are lost.

That’s why Rep. Ayanna Pressley and Sen. Ed Markey are pushing Congress to pass the Qualified Immunity Abolition Act — legislation that would finally allow families to seek justice when federal officers violate civil rights.

Right now, the judge-made doctrine of qualified immunity makes it nearly impossible for victims to win in court.  In practice, that means abuse goes unpunished, and grieving families are left with no recourse. Federal agents, including ICE officers, are granted extraordinary powers with almost no consequences when those powers are misused.

This is not theoretical. It’s happening now, in our communities.

We are calling on Congress to pass the Qualified Immunity Abolition Act immediately, with no loopholes. End qualified immunity for federal officers, including ICE. Strengthen civil rights enforcement so families can finally have their day in court.

Every delay protects misconduct. Every delay denies justice.
