Judge Immergut’s ruling came after a three-day trial where Trump’s lawyers failed to prove that Portland faced anything close to a “rebellion” or that federal officers were unable to do their jobs. In fact, she found no credible evidence that protests were out of control, and concluded that Trump’s actions violated the Tenth Amendment and exceeded presidential authority.

Her decision keeps Oregon’s streets under the control of the people and their elected leaders — not a president attempting to use military force for political gain. The ruling also affirms that dissent and peaceful protest are not grounds for militarization.
