Applaud the Kansas Supreme Court for Protecting Mail Voting

Every eligible voter deserves to have their ballot counted—and the Kansas Supreme Court deserves applause for helping protect that fundamental right.

Just days before Kansas' primary election, the state's highest court rejected a last-minute effort to enforce a law that would have discarded mail ballots arriving after Election Day, even if they were mailed on time. Instead, the court left in place a temporary injunction allowing ballots postmarked by Election Day and received within three days to be counted.

No voter should lose their voice because of delays in the postal system that are completely beyond their control. By preserving the existing rules while the legal challenge continues, the court helped ensure that Kansans who follow the law and vote on time won't be unfairly disenfranchised.

Free and fair elections depend on making it possible for every eligible voter to participate. Protecting lawful mail ballots strengthens confidence in our democracy and ensures that election outcomes reflect the will of the people—not the speed of the mail.

By refusing to change the rules just days before an election, the Kansas Supreme Court upheld fairness, stability, and the fundamental principle that every valid vote deserves to be counted.
