Applaud the Judge Who Defended Venezuelan Migrants

A federal judge just delivered a meaningful victory for fairness, constitutional rights, and the rule of law — and it’s worth celebrating.

U.S. District Judge James Boasberg has ordered the Trump administration to facilitate the return to the United States of Venezuelan migrants who were deported to El Salvador under the Alien Enemies Act without due process, allowing them the chance to challenge their deportations in court. The group of 137 men — sent to El Salvador’s notorious CECOT maximum-security prison and later moved to other countries — were denied their constitutional rights when they were removed without being given a fair hearing.

Judge Boasberg found that their removals violated fundamental due process protections and ruled that the government must help return those who want to pursue their legal claims. That includes covering travel and ensuring they can appear at U.S. ports of entry or be flown back for hearings.

This decision reaffirms a central tenet of American justice: no one should be deported without the opportunity to be heard and defend themselves in court. It underscores that even powerful executive actions — like invoking an 18th-century law — must comply with the Constitution and respect human dignity.
