Applaud the Judge Who Defended Due Process in Deportations

A federal judge just reaffirmed a fundamental American principle: no one should be deported to a country where they could face persecution or torture without meaningful notice and the chance to challenge that decision.

U.S. District Judge Brian Murphy ruled that the Trump administration cannot remove people to third countries — places they have no connection to and that are not listed on their final removal orders — without first providing due process. That means clear notice, time to respond, and a real opportunity to raise fears of persecution, torture, or death.

Congress has been explicit: the United States may not send someone to a country where their life or freedom would be threatened. Those protections are rooted in U.S. law and international agreements against torture. They are not optional — and they are not subject to political convenience.

The ruling came after migrants were deported to countries that were not listed on their removal paperwork, without adequate opportunity to challenge the move. Judge Murphy made clear that the government must follow the law and respect constitutional safeguards.
