Applaud the Judge for Protecting Mail-In Voting

A federal judge is keeping Donald Trump’s new mail-voting restrictions on hold, refusing the administration’s request to lift a temporary order blocking the U.S. Postal Service from imposing sweeping new requirements ahead of the November midterms.

U.S. District Judge Indira Talwani emphasized that voters and election officials need “clear and settled” rules as Election Day approaches. With the midterms now just two months away, she warned that last-minute federal changes to state election practices could create unnecessary disruption and uncertainty.

The new USPS regulations would require states to redesign ballot envelopes and submit voter information to a federal database. USPS could then refuse to mail ballots to voters in states that do not comply—potentially jeopardizing access to mail voting for millions of Americans.

Judge Talwani had previously blocked Trump’s executive order, but the Supreme Court ruled that her earlier injunction came too soon because USPS had not yet finalized its regulations. Now that the final rule has been issued, Talwani made clear that the administration cannot simply claim that challenges to it are too late.

Voting rules should be clear, lawful, and stable—not dramatically rewritten by a federal agency just weeks before Americans begin casting their ballots.
