Applaud the Courts for Defending Due Process

Due process is a cornerstone of American democracy—and these federal courts deserve applause for protecting it.

In two rulings issued just hours apart, federal appeals courts rejected the Trump administration's effort to deny bond hearings to immigrants detained by ICE. The courts found that the administration had improperly interpreted immigration law to justify mandatory detention for people already living in the United States, reaffirming that the government cannot ignore legal protections guaranteed under the law.

These decisions mark the fifth and sixth consecutive appellate court losses for the administration on this issue, with judges across the country concluding that longstanding immigration laws do not authorize the sweeping detention policy the administration has pursued.
