Applaud the Court’s Ruling Protecting Birth Control Access

In a major win for reproductive rights, a federal judge has struck down the Trump administration’s sweeping “religious and moral” exemptions to the Affordable Care Act’s birth control mandate.

The 2017 rules would have allowed nearly any employer or insurer — for-profit or nonprofit — to deny employees no-cost contraception coverage, jeopardizing access for millions of people. Judge Wendy Beetlestone ruled that these exemptions were arbitrary, capricious, and an overreach of agency authority, with no real connection to resolving conflicts with religious freedom law.

This decision reaffirms that reproductive health care is a right, not a privilege, and that personal beliefs of employers cannot override the health needs of their workers. Thanks to the legal challenge brought by Pennsylvania, New Jersey, and other states, the ACA’s promise of affordable birth control remains intact.
