Applaud Judge Rejecting Prosecution Against Kilmar García

A federal judge has delivered a major victory for due process and the rule of law — and it deserves celebration.

A federal court dismissed the Justice Department’s criminal case against Kilmar Ábrego García, ruling that the prosecution appeared retaliatory and was only revived after he successfully challenged his wrongful deportation to El Salvador.

The judge made clear that the government cannot weaponize prosecutions against people simply because they exercised their constitutional rights or challenged unlawful actions in court.

This ruling is about accountability, fairness, and protecting the principle that no administration should be allowed to punish individuals for standing up for their rights.

In America, due process matters. Courts exist to ensure justice is not driven by political retaliation or abuse of power.

At a time when democratic institutions are being tested, this decision reaffirms that the rule of law still matters.
