Applaud Efforts to Bring Transparency to the Supreme Court

Democrats are fighting to shine a light on secretive Supreme Court decisions — and they deserve applause.

Representative Jamie Raskin has introduced legislation aimed at increasing transparency and accountability around the Supreme Court’s “shadow docket,” where major emergency rulings are often issued without full explanations or public scrutiny.

The proposed reforms would require the Court to publicly explain emergency rulings, provide greater transparency about how cases are selected, and strengthen oversight when decisions have sweeping impacts on millions of Americans.

This matters because the shadow docket has increasingly been used to decide major issues affecting voting rights, immigration, healthcare, education, and executive power — often without detailed reasoning or transparency.

In a democracy, institutions gain legitimacy through openness, accountability, and public trust — not secrecy.
