The Democratic National Committee is taking the Justice Department to court to find out whether the Trump administration has considered seizing ballots, voting machines, or other election materials before the 2026 midterm results are certified. The DNC filed a Freedom of Information Act lawsuit after requesting records from the DOJ and FBI about any planned, anticipated, or potential seizures surrounding federal elections. Nearly five months later, according to the lawsuit, the agencies had not produced responsive records. The concern is serious. Removing ballots or voting equipment before an election is certified could interfere with counting, recounts, chain-of-custody protections, and public confidence in the results. The request follows the FBI’s seizure earlier this year of more than 600 boxes of records from Georgia’s already-certified 2020 election. Importantly, the lawsuit does not claim that the administration has a plan to seize ballots during the midterms. It seeks transparency about whether such actions have been contemplated and asks the court to require the government to disclose responsive records. Voters deserve to know that their lawfully cast ballots will remain secure and that federal agencies will not improperly interfere with the democratic process.
